1.3 Who is a Customer?

A Customer is any person who has entered into a Contract with the Provider, as well as any person to whom a Service or Product has been made available free of charge. A Customer may be a consumer or a business entity.

An entrepreneur is anyone who independently carries out a gainful activity on their own account and under their own responsibility, in a trade or similar manner, with the intention of doing so systematically for the purpose of making a profit. For the purposes of consumer protection and for the purposes of Section 1963 of the Civil Code, an entrepreneur is also considered to be any person who enters into contracts related to their own commercial, manufacturing, or similar activities, or in the independent practice of their profession, or a person acting on behalf of or for the account of an entrepreneur. If the Customer provides a business identification number (IČO) in the order, the rules applicable to consumers shall not apply to the Customer only if the Customer orders the Service or Product in connection with their business activities.

A consumer is a person who deals with the Provider or enters into a Contract outside the scope of their business or independent professional practice.

1.4 What is a Contract?

A “Contract” means a contract for the provision of a Service or the purchase of a Product concluded remotely via the Provider’s Website or by agreement between the parties, most commonly by telephone or email; Based on the Contract, the Provider undertakes to provide the Customer with the Service or to deliver the Product associated with the Service, within the agreed timeframe and under the terms and conditions set forth below. The Customer is obligated to pay the price agreed upon in the Contract for the Service or Product. A consumer contract is a Contract concluded with a consumer; consumer protection does not apply to business entities.

1.5 What are the Services and Products offered?

The Provider’s Service is the service described on the Website or agreed upon individually with the Customer, which consists primarily of individual coaching or personal and career development. This Service is provided exclusively by the Provider, either in person or online.

A Product is a product offered on the Provider’s Website that is related to the Service provided. This primarily includes an e-book, work materials, or membership in the Provider’s online program, in accordance with the price quote for the Product listed on the date of the Order. Each Product includes a description, price, and, where applicable, the period of availability.

2. IMPORTANT INFORMATION ABOUT THE NATURE OF COACHING

2.1 Who is coaching intended for?

Coaching is intended for individuals who, with the Provider’s support, wish to clarify where they are headed in life, what is preventing them from moving forward, and what specific next steps they should take on their journey. It is a collaborative development process that includes guided conversation, supporting techniques, and support for the Client in addressing personal, professional, or life-related issues. During this process, the Provider does not offer ready-made solutions but supports the Client in finding their own solutions. The client is responsible for their decision to use coaching and enters into it voluntarily.

Conversely, coaching is not a substitute for psychotherapy or medical care. If the Client has serious mental health issues, trauma, addiction, an acute crisis, or simply doubts whether coaching is appropriate, the Provider recommends consulting a qualified healthcare professional. The Provider may refuse or terminate the collaboration if, given the circumstances, coaching is not appropriate. For individuals under 18 years of age or those with limited legal capacity, the extent of their capacity and any need for consent or representation will be assessed in accordance with applicable laws.

2.2 Is coaching a health service?

Coaching is not a health service, and the Provider is not a qualified healthcare professional, psychotherapist, or psychologist. Coaching is not psychotherapy, psychiatric or psychological care, a health or social service, nor is it legal, tax, investment, or financial advice; coaching has no therapeutic or health-related effects and does not replace a qualified professional. It is a collaborative development process; the Provider does not provide ready-made solutions but supports the client in finding their own.

2.3 Who is responsible for the results?

The Client is responsible for their own life, their decisions, and how they apply the recommendations arising from the coaching process. The Provider does not guarantee any specific coaching outcome; results depend on the Client’s individual efforts and circumstances. This does not affect the Provider’s liability for breaches of statutory or contractual obligations, nor does it affect the Client’s rights—particularly those of a consumer—arising from defective performance or the right to compensation for damages to the extent that such rights cannot be contractually excluded or limited. If coaching is not appropriate, the Provider may recommend a specialist, make the continuation of consultations conditional, or terminate the collaboration.

3. HOW IS THE CONTRACT FORMED?

3.1 Where can you find the offer of Services and Products?

Information about Services and Products is available on the Provider’s Website; browsing the Offer is non-binding. In all cases listed below, the contract is concluded in the Czech language via means of distance communication.

3.2 How do you order a Product or Service through the Provider’s Website?

The Customer selects a Service, its format (in person or online), and the date in the reservation form on the Website and enters their first and last name, email address, and phone number. Before completing the order, the form displays a summary of the order, including the price of the Service.

Before completing the order, the Customer reviews the following documents and, by checking the appropriate boxes, confirms that they agree to their terms:

  1. General Terms and Conditions and Informed Consent to the Provision of Individual Coaching,
  2. for online Services, also the Guidelines and Consent for Online Coaching,
  3. Privacy Policy and Personal Data Protection (GDPR) – Consent to the Processing of Personal Data.

The Customer will then pay the price online by credit card via the Stripe payment gateway. For the free introductory consultation, no payment is required, and the reservation is completed upon submission.

The price is final, including taxes and fees, and is valid for as long as it is displayed.

3.3 When is the Contract Concluded?

The Customer will receive a confirmation email from the Provider at their email address acknowledging receipt of the order, including a summary and payment details. The Contract is formed upon payment of the price for the Service/Product. These General Terms and Conditions are permanently available on the Provider’s Website. The Contract is archived electronically only, in accordance with legal regulations.

3.4 How do you order a Product or Service by phone or email?

The Customer uses the form on the Website or sends an email, providing their name, contact email, and phone number, to schedule a free initial consultation with the Provider lasting no more than 20 minutes. Based on this initial contact, and provided there is mutual interest, the Provider will send the prospective customer a specific offer detailing the duration, and the price of the Service—usually via email—along with a link for payment by credit card and the required documents listed in Section 3.2 of these General Terms and Conditions. The Customer will reply to the email indicating their acceptance of the offer. The contract is concluded at the moment the Customer pays for the Service/Product.

3.5 What are the Customer’s obligations?

The Customer is required to provide accurate information in the order, to verify its accuracy and truthfulness before submitting it, and to immediately notify the Provider of any changes to such information. By submitting the order or accepting the offer, the Customer confirms that they have read and agree to the mandatory documents listed in Section 3.2 of these General Terms and Conditions. The contract is concluded for a fixed term until the mutual obligations of the contracting parties have been fulfilled.

4. HOW CAN THE PRICE BE PAID?

4.1 How can the price be paid, and when is it considered paid?

The Customer shall pay the price for the Service or Product online by credit card via the Stripe payment gateway when placing an order on the Website, or via a payment link sent by email. Payment is processed through the Stripe payment gateway via an encrypted channel and in accordance with international security standards ensuring the protection of credit card data. Payments are accepted in CZK or EUR and are considered paid upon crediting the full amount to the Provider’s account.

4.2 What are the other payment terms?

Invoices are sent electronically via email immediately after the full amount is credited to the Provider’s bank account. The provision of the Service and/or delivery of the Product requires payment in full in advance. If the price is not paid properly and on time, the Provider may request payment from the Customer and grant the Customer a reasonable additional period for payment. If this additional payment period expires without payment, the Customer’s obligation to pay the price remains unfulfilled and the Contract is not concluded (does not come into effect).

5. HOW IS THE COACHING SERVICE PROVIDED?

5.1 Who Provides the Service?

The Service is provided in person exclusively by the Provider.

5.2 How is a coaching session scheduled?

The first coaching session is bindingly scheduled by selecting a specific date and time from the calendar on the Website when the Customer places an order. After the Contract is concluded (i.e., upon payment of the fee), the Provider will send the Customer a confirmation email with a detailed description of the next steps. If the Contract is concluded by phone or email, the Customer will schedule the first session with the Provider by mutual agreement using the same method by which the Contract was concluded. Once the fee has been paid, the coaching session is binding for both parties.

5.3 Is it possible to change the coaching session date?

A coaching session may be rescheduled or canceled only under the following conditions: No later than 24 hours before the session, the session may be rescheduled or canceled without a cancellation fee via the booking overview on the Website (the link is included in the confirmation email), or by phone or email to the Provider.

If the session is canceled less than 24 hours in advance, the cancellation fee is 100% of the Service price, the same as in the case of the Customer’s unexcused absence from the coaching session.

The Provider will not charge the Customer cancellation fees in the event of clear proof of illness or another serious reason on the part of the Customer, provided that this fact is notified in advance, properly, and verifiably, and subsequently documented; Upon agreement, the Service may be rescheduled for an alternative date.

The Provider may also change the coaching date due to its own illness or other serious reasons, in which case it is obligated to notify the Customer without undue delay. The Customer is entitled to choose either a 100% refund of the Service price or to arrange an alternative date.

If, in all of the above cases, the parties fail to agree on a new coaching date within 30 days of the originally canceled date (and, if applicable, to pay any outstanding balance to cover the full price of the Service, provided that a cancellation fee was included in the price), the parties are entitled to withdraw from the Agreement. In such a case, the Provider will apply the cancellation fee against the price already paid for the Service and refund the difference to the bank account from which the payment was made, no later than 14 days after one of the contracting parties withdraws from the Agreement.

5.4 How does the Service work?

The Provider delivers the Service in person at a prearranged location or online via an agreed-upon application (specifically Microsoft Teams, Zoom, or Google Meet). The Customer is required to ensure that the technical conditions on their end are in good working order (specifically, a fully charged device, up-to-date browser and software, a stable internet connection, and a private, undisturbed environment). Otherwise, the Customer is not entitled to a rescheduled session for the disrupted Coaching Service or to a refund of the Service fee. If the issue lies with the Provider’s technical equipment, the Provider will arrange a new rescheduled coaching session with the Customer.

The Customer acknowledges that the applications through which the Service will be provided, as agreed, are operated by third parties; therefore, the Provider is not responsible for their operation, availability, security, or functionality.

5.5 What about confidentiality?

The Provider shall maintain confidentiality regarding all information disclosed by the Customer during the coaching sessions, except in cases provided for by the laws of the Czech Republic.

5.6 Can online coaching sessions be recorded?

The online coaching service may not be recorded by the Client. Sessions are not automatically recorded. If the Client wishes to make a recording of the coaching session, such a recording may only be made with the Provider’s prior written consent and exclusively for the Client’s personal use (the same applies to recordings made by the Provider, which require the Client’s prior written consent). Such a recording may not be distributed, edited, or used publicly in any way. The Customer is responsible for ensuring its security.

6. WHAT SPECIAL RIGHTS DOES THE CONSUMER HAVE?

6.1 Statutory Right to Withdraw from a Distance Contract: The Consumer has the right to withdraw from a contract concluded remotely without giving any reason within 14 calendar days of its conclusion. However, if the subject matter of the Contract is the provision of a Service, this right is modified as follows.

6.2 When is it not possible to withdraw from the Contract within 14 calendar days of its conclusion without giving a reason?

The consumer cannot withdraw from a Contract for the provision of a Service within 14 days of its conclusion without giving a reason if the Service has already been fully provided. If, when entering into the Contract, the Customer selects a coaching date before the expiration of the 14-day withdrawal period (i.e., if the Customer requests that the Provider begin performance before the expiration of the statutory withdrawal period), the Provider is legally obligated to inform the Customer that by doing so, the Customer forfeits the right to withdraw from the Contract pursuant to Section 1829 of the Civil Code.

For the delivery of Products associated with coaching, the right to withdraw from the Contract is governed by statutory conditions.

6.3 How can the Customer withdraw from the Contract during the provision of the Service if they are not satisfied with the Service?

The Customer is entitled to withdraw from the Contract during the coaching period if they are not satisfied with the Service or if it does not suit them in any other way, no later than 5 calendar days before the next coaching session. The Customer may do so by sending an email to the Provider’s email address listed on its Website. The Customer will not receive a refund for Services already provided. If the Customer has purchased a discounted Service package that includes more than one coaching session at a discounted price, the Provider shall refund to the Customer the difference between the full price paid by the Customer for the Service package and the price of the coaching sessions already completed, valued at the full amount as of the date the Contract was concluded without any price discount.

Supervision of compliance with obligations is carried out, within the scope of their authority, primarily by the Czech Trade Inspection Authority, the relevant trade licensing office, and, in the case of personal data processing, the Office for Personal Data Protection. A consumer dispute that cannot be resolved by mutual agreement may be referred by the consumer Customer to the Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Prague 2, or follow the current guidelines issued by that entity.

7. WHAT ARE THE CUSTOMER’S OBLIGATIONS?

7.1 What are the basic obligations?

The Customer is obligated to pay the price for their order.

The Customer acknowledges that the Services and/or Products are non-transferable; therefore, they are intended solely for the Customer’s own use or, as the case may be, for the use of the person on whose behalf the Customer entered into the Agreement as a legal representative.

The Customer shall protect the login credentials provided by the Provider and respect the confidentiality of the sessions.

7.2 Copyright Protection

The content of the Website, Services, and/or Products constitutes a copyrighted work and the result of the Provider’s intellectual activity, which is protected in particular by copyright law and other legal regulations governing intellectual property rights. The Customer may not teach the knowledge and skills, use them commercially, or pass them off as their own; may not copy, reproduce, store, modify, sell, offer, distribute, or share the content and materials obtained from the Provider without crediting the author, nor may the Customer allow any third party to do so. In the event of a breach of these obligations, the Customer is liable for any damages thereby caused to the Provider, in accordance with applicable laws.

8. HOW DO REVIEWS WORK?

8.1 Who Provides Reviews and How?

Any Customer may provide the Provider with a review of the Services provided and/or Products delivered in text or media form on the Website, social media, or other channels. The Provider reasonably verifies whether a review comes from a person who actually purchased or used the Service and/or Product, in particular by comparing it with records of orders, payments, and Services actually provided.

8.2 Which reviews will be published?

The Provider selects reviews from verified Customers for publication at its discretion. The Provider will publish a review only to the extent that is reasonable for the purpose of its publication and in accordance with data protection rules. When submitting a review, the Customer may indicate whether they wish it to be published anonymously; without a separate legal basis, the Provider will not publish the name or any other personal data beyond what is necessary for the publication of the review. If the Customer does not wish for the review to be published, they must expressly state this when submitting it; the review will then not be published.

9. HOW TO FILE A CLAIM?

9.1 What rules apply to complaints?

Rights arising from defective performance are governed by the Civil Code and, if the Customer is a consumer, by the Consumer Protection Act. The Provider is responsible for ensuring that the Service and/or Product is free of defects, corresponds to the description on the Website, and complies with the agreed-upon Contract.

9.2 When does the Customer not have rights arising from defective performance?

The Provider is not liable for defects resulting from a slow internet connection or data transfer, an outdated browser, or missing software on the Customer’s end. Furthermore, the Provider is not liable for defects if the Customer was aware of the defect in advance, if the Customer caused the defect, or if the digital content is temporarily unavailable due to maintenance or a server outage.

9.3 How can a complaint be filed, and what are the procedures for resolving it?

A complaint must be sent without undue delay to the Provider’s email address listed on its Website. A complaint is considered filed upon receipt by the Provider. The Provider will issue a confirmation of the complaint, including its content, the deadline for resolution, and the method of resolution, or a written explanation stating that the complaint has been rejected. If the Customer is a consumer, the Provider shall resolve the complaint, including the rectification of the defect, and inform the Customer of the resolution no later than 30 days from the date the complaint was filed, unless a longer period is agreed upon with the Customer. The failure to meet this deadline entitles the Customer to withdraw from the Contract or to demand a reasonable discount, provided that the statutory conditions are met.

The Customer (consumer) may request that the defect be remedied by providing a new (defect-free) Service, delivering a new Product, or supplementing the digital content or digital service, if this is possible and reasonable. The Provider may refuse the chosen method if it is impossible or unreasonably costly. The Customer may request a reasonable discount or withdraw from the Contract in cases specified by law, particularly if the Provider fails to remedy the defect within a reasonable time or if the defect constitutes a material breach of the Contract; the Contract may not be terminated due to a minor defect. With regard to digital content and digital services, the rights of the Customer who is a consumer are also governed by the provisions of Section 2389a et seq. of the Civil Code.

For a Customer who is not a consumer, the procedure is governed by the Civil Code and the reasonable nature of the defect.

10. WHAT LAW GOVERN THE CONTRACTUAL RELATIONSHIP?

10.1 What governs the legal relationships arising from the Contract?

The legal relationships between the Provider and the Customer arising from the Contract are governed by the Contract, these General Terms and Conditions, and the applicable laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, as amended.

In the event of a conflict between a provision of the Contract and these General Terms and Conditions, the provision of the Contract shall prevail. The provisions of these General Terms and Conditions shall apply to the extent that they do not conflict with mandatory provisions of law.

If the Customer is a consumer, the provisions of consumer protection laws shall also apply to the legal relationship. Neither the provisions of these General Terms and Conditions nor the Contract may deprive the consumer of or limit the rights granted to them by law.

If any provision of these General Terms and Conditions proves to be invalid, ineffective, or unenforceable, this shall not affect the validity and effectiveness of the remaining provisions. The contracting parties undertake to replace such a provision with a new provision that corresponds as closely as possible to the original provision in terms of its purpose and meaning.

10.2 Can the General Terms and Conditions be amended, and how are they interpreted?

The Provider may reasonably amend the General Terms and Conditions for future Contracts, provided that the new version of the General Terms and Conditions is published in advance. Unless expressly agreed by the parties, the amended General Terms and Conditions shall not apply to a Contract that has already been concluded.

In the event of any ambiguity regarding a foreign-language version of these General Terms and Conditions, the Czech version and its interpretation shall prevail.

10.3 How Is Personal Data Protected?

Information regarding the protection of the Customer’s personal data, the manner in which it is processed, and the Customer’s rights is provided in the section “Personal Data Processing and Protection Policy (GDPR)” published on the Provider’s Website.
